{"data":{"id":"us-ut/utah-code-35a-3-201","jurisdiction":"us-ut","citation":"Utah Code § 35A-3-201","heading":"Definitions.","body":"As used in this part:\n(1) \"Child care\" means the child care services defined in Section 35A-3-102 for:\n(a) children age 12 or younger; and\n(b) children with disabilities age 18 or younger.\n(2) \"Child care provider association\" means an association:\n(a) that has functioned as a child care provider association in the state for at least three years; and\n(b) is affiliated with a national child care provider association.\n(3) \"Committee\" means the Child Care Advisory Committee created in Section 35A-3-205.\n(4) \"Director\" means the director of the Office of Child Care.\n(5)\n(a) \"Income\" means gross income, whether earned or unearned, as defined by rule made in accordance with Section 35A-3-203.\n(b) \"Income\" does not include:\n(i) income from means-tested programs, including:\n(A) Temporary Assistance to Needy Families;\n(B) the Social Security Act; and\n(C) the Supplemental Nutrition Assistance Program;\n(ii) in-kind income;\n(iii) scholarship, grant, or bona fide loan money;\n(iv) a federal or state income tax credit; or\n(v) a nonrecurring lump sum benefit.\n(6) \"Income-eligible child\" means a child whose:\n(a) family income does not exceed 85% of state median income for a family of the same size; and\n(b) family assets do not exceed the limit established by the office through rule created in accordance with Section 35A-3-203.\n(7) \"Office\" means the Office of Child Care created in Section 35A-3-202.","path":["Title 35A Utah Workforce Services Code","Chapter 35A-3 Employment Support Act","Part 35A-3-2 Office of Child Care"],"source_url":"https://le.utah.gov/xcode/Title35A/Chapter3/35A-3-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"34623a05cf4b9da02a2f30cbfc30a8f5e0a198a165d4ee826dd765fe8f799fd1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-35a-3-118","next":"us-ut/utah-code-35a-3-202"},"notice":"GroundRules: Original legal text.
