{"data":{"id":"us-ut/utah-code-35a-5-302","jurisdiction":"us-ut","citation":"Utah Code § 35A-5-302","heading":"Definitions.","body":"As used in this part:\n(1) \"Date of hire\" means the date a person who is homeless first performs labor or services for compensation for an employer.\n(2) \"Governmental entity\" is as defined in Section 59-2-511.\n(3) \"Permanent housing, permanent supportive, or transitional facility\" means a facility:\n(a) located within the state;\n(b) that provides supervision of residents of the facility; and\n(c) that is:\n(i) a publicly or privately operated shelter:\n(A) designed to provide temporary living accommodations, including a welfare hotel, congregate shelter, or transitional housing for the mentally ill; and\n(B) that receives federal homeless assistance funding distributed by the United States Department of Housing and Urban Development; or\n(ii) an emergency shelter that receives homeless assistance funding from a county, city, or town.\n(4) \"Person who is homeless\" means an individual whose primary nighttime residence is:\n(a) a public or private place not designated for or ordinarily used as a regular sleeping accommodation for an individual, including a car, park, abandoned building, bus station, train station, airport, or camping ground; or\n(b) a publicly or privately operated shelter designated to provide temporary living arrangements, including a permanent housing, permanent supportive, or transitional facility.\n(5) \"Wage requirement\" means that an employer pays a person who is homeless $4,000 or more in wages during a time period that:\n(a) begins on the date of hire; and\n(b) ends no later than two calendar quarters after the calendar quarter in which the date of hire occurs.","path":["Title 35A Utah Workforce Services Code","Chapter 35A-5 Training and Workforce Improvement Act","Part 35A-5-3 Tax Credit for Employment of Persons Who Are Homeless Act"],"source_url":"https://le.utah.gov/xcode/Title35A/Chapter5/35A-5-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"149ec43c9214365562e29274f9a9f7df6f9eb82adad8fac97f7a7841d099fb48","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-35a-5-301","next":"us-ut/utah-code-35a-5-303"},"notice":"GroundRules: Original legal text.
