{"data":{"id":"us-ut/utah-code-36-35-104","jurisdiction":"us-ut","citation":"Utah Code § 36-35-104","heading":"Review of court rules -- Criteria.","body":"(1) As used in this section, \"court rule\" means a proposal for a court rule, a new court rule, or an existing court rule.\n(2) The committee may review and evaluate:\n(a) a submission of:\n(i) a new court rule; or\n(ii) a proposal for a court rule; and\n(b) an existing court rule.\n(3) If the committee chooses to conduct a review of a court rule as provided under Subsection (2), the review shall be based on the following criteria:\n(a) whether the court rule is authorized by the state constitution or by statute;\n(b) if authorized by statute, whether the court rule complies with legislative intent;\n(c) whether the court rule is in conflict with existing statute or governs a policy expressed in statute;\n(d) whether the court rule is primarily substantive or procedural in nature;\n(e) whether the court rule infringes on the powers of the executive or legislative branch of government;\n(f) the impact of the court rule on an affected person;\n(g) the purpose for the court rule, and if applicable, the reason for a change to an existing court rule;\n(h) the anticipated cost or savings due to the court rule to:\n(i) the state budget;\n(ii) local governments; and\n(iii) individuals; and\n(i) the cost to an affected person of complying with the court rule.","path":["Title 36 Legislature","Chapter 36-35 General Oversight Committee","Part 36-35-1 General Oversight Committee"],"source_url":"https://le.utah.gov/xcode/Title36/Chapter35/36-35-S104.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ad2c94f583fefc6c22e0c2f86d63bbdef02fe4e96845713aeb3dbb081cdc6610","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-36-35-103","next":"us-ut/utah-code-38-1a-101"},"notice":"GroundRules: Original legal text.
