{"data":{"id":"us-ut/utah-code-38-11-110","jurisdiction":"us-ut","citation":"Utah Code § 38-11-110","heading":"Issuance of certificates of compliance.","body":"(1)\n(a) The director may issue a certificate of compliance only after determining through an informal proceeding, as set forth in Title 63G, Chapter 4, Administrative Procedures Act:\n(i) that the owner is in compliance with Subsections 38-11-204(4)(a) and (b); or\n(ii) subject to Subsection (2), that the owner is entitled to protection under Subsection 38-11-107(1)(b).\n(b) If the director determines through an informal proceeding under Subsection (1)(a) that an owner seeking the issuance of a certificate of compliance under Subsection (1)(a)(i) is not in compliance as provided in Subsection (1)(a)(i), the director may not issue a certificate of compliance.\n(2)\n(a) An owner seeking the issuance of a certificate of compliance under Subsection (1)(a)(ii) shall submit an affidavit, as defined by the division by rule, affirming that the owner is entitled to protection under Subsection 38-11-107(1)(b).\n(b) If an owner's affidavit under Subsection (2)(a) is disputed, the owner may file a complaint in a court with jurisdiction under Title 78A, Judiciary and Judicial Administration, to resolve the dispute.\n(c) The director may issue a certificate of compliance to an owner seeking issuance of a certificate under Subsection (1)(a)(ii) if:\n(i) the owner's affidavit under Subsection (2)(a) is undisputed; or\n(ii) a court resolves any dispute over the owner's affidavit in favor of the owner.","path":["Title 38 Liens","Chapter 38-11 Residence Lien Restriction and Lien Recovery Fund Act","Part 38-11-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title38/Chapter11/38-11-S110.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"c39f7e5b728a74be442f8407e68de6a4a1ba0564370ddeea8b52fc9f8f769361","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-38-11-109","next":"us-ut/utah-code-38-11-201"},"notice":"GroundRules: Original legal text.
