{"data":{"id":"us-ut/utah-code-38-11-301","jurisdiction":"us-ut","citation":"Utah Code § 38-11-301","heading":"Registration as a qualified beneficiary -- Initial regular assessment -- Affidavit.","body":"(1) A person licensed as of July 1, 1995, as a contractor under the provisions of Title 58, Chapter 55, Utah Construction Trades Licensing Act, in license classifications that regularly engage in providing qualified services shall be automatically registered as a qualified beneficiary.\n(2) A person applying for licensure as a contractor after July 1, 1995, in license classifications that regularly engage in providing qualified services shall be automatically registered as a qualified beneficiary upon issuance of a license.\n(3)\n(a) After July 1, 1995, any person providing qualified services as other than a contractor as provided in Subsection (1) or any person exempt from licensure under the provisions of Title 58, Chapter 55, Utah Construction Trades Licensing Act, may register as a qualified beneficiary by:\n(i) submitting an application in a form prescribed by the division;\n(ii) demonstrating registration with the Division of Corporations and Commercial Code as required by state law; and\n(iii) paying a registration fee determined by the division under Section 63J-1-504.\n(b) A person who does not register under Subsection (1), (2), or (3)(a) shall be prohibited from recovering under the fund as a qualified beneficiary for work performed as qualified services while not registered with the fund.","path":["Title 38 Liens","Chapter 38-11 Residence Lien Restriction and Lien Recovery Fund Act","Part 38-11-3 Registration"],"source_url":"https://le.utah.gov/xcode/Title38/Chapter11/38-11-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3296ccf14f0a9ac1691d05373b88cec8c705826de89415d29b6bede4b3d1353e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-38-11-207","next":"us-ut/utah-code-38-12-101"},"notice":"GroundRules: Original legal text.
