{"data":{"id":"us-ut/utah-code-4-41-103.1","jurisdiction":"us-ut","citation":"Utah Code § 4-41-103.1","heading":"Authority to regulate production, sale, and testing of cannabinoid products and industrial hemp -- Information sharing with the State Tax Commission.","body":"(1) The department shall make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:\n(a) establish requirements for a cannabinoid processor license to process cannabinoid products;\n(b) establish requirements for an industrial hemp retailer permit to market or sell industrial hemp products;\n(c) establish the standards, methods, practices, and procedures a laboratory must use when:\n(i) testing industrial hemp, transportable industrial hemp concentrate, and cannabinoid products; and\n(ii) disposing of non-compliant material;\n(d) establish requirements for registration of processors of non-cannabinoid industrial hemp products; and\n(e) establish standards for transporting transportable industrial hemp concentrate into and out of the state.\n(2) The department shall maintain a list of each licensee and permittee.\n(3) Beginning January 1, 2025, the department shall provide to the State Tax Commission:\n(a) a regularly updated list of every retailer permittee that sells a cannabinoid product;\n(b) any information obtained by the department regarding a person who is not a retailer permittee and is selling a cannabinoid product; and\n(c) the tax identification number:\n(i) for a retailer permittee described in Subsection (3)(a); and\n(ii) a person described in Subsection (3)(b).","path":["Title 4 Utah Agricultural Code","Chapter 4-41 Hemp and Cannabinoid Act","Part 4-41-1 Industrial Hemp"],"source_url":"https://le.utah.gov/xcode/Title4/Chapter41/4-41-S103.1.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"cbaafe3a5a276586298b2ffb0a64fee3385d435347afe3bd31188c8d57c0e252","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-4-41-102","next":"us-ut/utah-code-4-41-103.2"},"notice":"GroundRules: Original legal text.
