{"data":{"id":"us-ut/utah-code-4-41a-501","jurisdiction":"us-ut","citation":"Utah Code § 4-41a-501","heading":"Cannabis cultivation facility -- Operating requirements.","body":"(1) A cannabis cultivation facility shall ensure that any cannabis growing at the cannabis cultivation facility is not visible from the ground level of the cannabis cultivation facility perimeter.\n(2) A cannabis cultivation facility shall use a unique identifier that is connected to the facility's inventory control system to identify:\n(a) beginning at the time a cannabis plant is eight inches tall and has a root ball, each cannabis plant;\n(b) each unique harvest of cannabis plants;\n(c) each batch of cannabis the facility transfers to a medical cannabis pharmacy, a cannabis processing facility, or an independent cannabis testing laboratory; and\n(d) any excess, contaminated, or deteriorated cannabis of which the cannabis cultivation facility disposes.\n(3) A cannabis cultivation facility shall identify cannabis biomass as cannabis byproduct or cannabis plant product before transferring the cannabis biomass from the facility.\n(4) A cannabis cultivation facility shall either:\n(a) ensure that a cannabis processing facility chemically or physically processes cannabis cultivation byproduct to produce a cannabis concentrate for incorporation into cannabis derivative products; or\n(b) destroy cannabis cultivation byproduct in accordance with Section 4-41a-405.\n(5)\n(a) A cannabis cultivation facility may, for quality assurance or remediation purposes, use methods and equipment as approved by the department through rule.\n(b) The department shall allow the use of radiation-based methods and equipment in rules created under Subsection (5)(a).\n(6) The department shall make rules establishing:\n(a) the records a cannabis cultivation facility shall keep regarding each batch, amount of product treated, and the methods used; and\n(b) disclosure requirements to a cannabis processor receiving the material subject to the radiation including the methods and equipment used.","path":["Title 4 Utah Agricultural Code","Chapter 4-41a Cannabis Production Establishments and Pharmacies","Part 4-41a-5 Cannabis Cultivation Facility Operating Requirements"],"source_url":"https://le.utah.gov/xcode/Title4/Chapter41a/4-41a-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"688c91b4fb113f42ff8f06c655c3675a7e247c65d51d52963b46cf3b67c076cd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-4-41a-406","next":"us-ut/utah-code-4-41a-502"},"notice":"GroundRules: Original legal text.
