{"data":{"id":"us-ut/utah-code-4-41a-901","jurisdiction":"us-ut","citation":"Utah Code § 4-41a-901","heading":"Academic medical cannabis research -- License.","body":"(1) A medical cannabis research licensee may, subject to department rules described in Subsection (4), obtain from a cannabis production establishment or a medical cannabis pharmacy, and possess cannabis for academic medical cannabis research.\n(2) The department shall license a research university to obtain and possess cannabis for the purpose of academic medical cannabis research if the research university submits to the department:\n(a) the location where the research university intends to conduct the research;\n(b) the research university's research plan; and\n(c) the name of the principal investigator of the research university who will:\n(i) supervise the procurement, possession, and security of cannabis and cannabis product; and\n(ii) oversee the academic research.\n(3) The department shall maintain a list of each medical cannabis research licensee.\n(4) The department shall make rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:\n(a) establish requirements for a licensee to:\n(i) participate in academic medical cannabis research;\n(ii) obtain from a cannabis production establishment, and possess, cannabis for academic medical cannabis research; and\n(b) set sampling and testing procedures.\n(5) A medical cannabis research licensee shall provide to the department written consent allowing a representative of the department and local law enforcement to enter all premises where the licensee possesses or stores cannabis for the purpose of:\n(a) conducting a physical inspection; or\n(b) ensuring compliance with the requirements of this chapter.\n(6) An individual who has been convicted of a drug related felony within the last 10 years may not obtain, possess, or conduct any research on cannabis under a medical cannabis research licensee's license under this part.\n(7) The department may set a fee, in accordance with Subsection 4-2-103(2), for the application for a medical cannabis research license.","path":["Title 4 Utah Agricultural Code","Chapter 4-41a Cannabis Production Establishments and Pharmacies","Part 4-41a-9 Academic Medical Cannabis Research"],"source_url":"https://le.utah.gov/xcode/Title4/Chapter41a/4-41a-S901.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"7039e0bedf45947b641085d46c40ae3c3ebf51ca714d2dee3d691265acfdf313","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-4-41a-802","next":"us-ut/utah-code-4-41a-902"},"notice":"GroundRules: Original legal text.
