{"data":{"id":"us-ut/utah-code-40-11-13","jurisdiction":"us-ut","citation":"Utah Code § 40-11-13","heading":"Reservoir integrity.","body":"(1) Carbon dioxide injected into and stored in a reservoir in compliance with the requirements of this section is not:\n(a) pollution, as that term is defined in Section 4-18-103; or\n(b) a private nuisance or a public nuisance, as defined in Section 78B-6a-101.\n(2) A reservoir is only appropriate for geologic carbon storage if the board determines and the operator demonstrates that:\n(a) carbon dioxide cannot escape the reservoir at a rate exceeding the lower of 1% or the standard recommended by the Environmental Protection Agency;\n(b) no additional substances will be introduced into the storage facility that could compromise the integrity of the storage reservoir; and\n(c) the operator has a plan to maintain the integrity of the reservoir.\n(3) When making a determination described in Subsection (2), the board may rely upon:\n(a) a finding from the Utah Geological Survey, created in Section 79-3-201 that the reservoir is appropriate for the storage of carbon dioxide; and\n(b) reports and findings from the Department of Environmental Quality, created in Section 19-1-104.\n(4) The board shall take action to enforce the provisions of this section.","path":["Title 40 Mines and Mining","Chapter 40-11 Geologic Carbon Storage"],"source_url":"https://le.utah.gov/xcode/Title40/Chapter11/40-11-S13.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"40646edf3877563914b07bdcb38ac661da24aa9fb0008590a46175e45aaaa067","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-40-11-12","next":"us-ut/utah-code-40-11-14"},"notice":"GroundRules: Original legal text.
