{"data":{"id":"us-ut/utah-code-40-11-2","jurisdiction":"us-ut","citation":"Utah Code § 40-11-2","heading":"Preemption.","body":"(1) Regulation of geologic carbon storage is of statewide concern and the state regulation of geologic carbon storage activity occupies the whole field of geologic carbon storage subject to:\n(a) the granting of primacy over Class VI geologic sequestration wells; and\n(b) relevant federal law.\n(2) The legislative body of a political subdivision may enact, amend, or enforce a local ordinance, resolution, or rule consistent with the political subdivision's general land use authority that:\n(a) regulates only surface activity that is incidental to geologic carbon storage activity;\n(b) does not effectively or unduly limit, ban, or prohibit geologic carbon storage activity; and\n(c) is not otherwise preempted by state or federal law.","path":["Title 40 Mines and Mining","Chapter 40-11 Geologic Carbon Storage"],"source_url":"https://le.utah.gov/xcode/Title40/Chapter11/40-11-S2.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"917a1b430559ce7b01530263d9d155ad72c9d046484b0b28dc6ff93af12639fa","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-40-11-1","next":"us-ut/utah-code-40-11-3"},"notice":"GroundRules: Original legal text.
