{"data":{"id":"us-ut/utah-code-40-11-4","jurisdiction":"us-ut","citation":"Utah Code § 40-11-4","heading":"Board and division permit authority.","body":"To the extent required to authorize and issue permits and to regulate geologic carbon sequestration, the board and the division shall have authority:\n(1) over all persons and property necessary to administer and enforce this chapter and this chapter's objectives;\n(2) to regulate activities relating to a storage facility, including construction, operation, and closure;\n(3) to enter, at a reasonable time and manner, a storage facility to:\n(a) inspect equipment and surface storage facilities;\n(b) observe, monitor, and investigate operations; or\n(c) inspect records the board requires the operators maintain at the storage facility;\n(4) to require that storage operators provide assurance, including bonds, that money is available to fulfill the storage operator's duties;\n(5) to exercise continuing jurisdiction over storage operators and storage facilities, including the authority, after notice and hearing, to amend provisions in a permit and to revoke a permit;\n(6) to dissolve or change the boundaries of any unit that is within or near a storage reservoir's boundaries; and\n(7) to oversee the expenditure of money from the fund to accomplish the purposes of this chapter.","path":["Title 40 Mines and Mining","Chapter 40-11 Geologic Carbon Storage"],"source_url":"https://le.utah.gov/xcode/Title40/Chapter11/40-11-S4.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f2f27023133ed0bac7e575de4f329e3d2de422e620e891df9f15cc9a40346914","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-40-11-3","next":"us-ut/utah-code-40-11-5"},"notice":"GroundRules: Original legal text.
