{"data":{"id":"us-ut/utah-code-40-2-302","jurisdiction":"us-ut","citation":"Utah Code § 40-2-302","heading":"Reporting of an unsafe condition in coal mines -- Adverse action prohibited.","body":"(1) Subject to the other provisions of this section, upon the office's receipt of information from a person of a possible unsafe condition in a coal mine located in Utah, the office may:\n(a) notify the federal Mine Safety and Health Administration;\n(b) notify another appropriate federal, state, or local government agency;\n(c) contact the operator of the coal mine;\n(d) refer the information to the council on a confidential basis; or\n(e) take any other authorized action.\n(2) The commission, council, or office may not disclose or otherwise make public the identity of a person who reports a possible unsafe condition in a coal mine located in Utah unless that person authorizes the commission, council, or office to disclose the person's identity.\n(3) A coal mine operator may not take adverse action against a person because that person:\n(a) reports an alleged unsafe mine condition; or\n(b) testifies, assists, or participates in any manner in an investigation, proceeding, or hearing under this chapter.","path":["Title 40 Mines and Mining","Chapter 40-2 Coal Mine Safety Act","Part 40-2-3 Safety Conditions"],"source_url":"https://le.utah.gov/xcode/Title40/Chapter2/40-2-S302.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"87325fc1780ec67700559aa07140a4b296d4712eb1a091c3f8a0274fbd6fb880","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-40-2-301","next":"us-ut/utah-code-40-2-303"},"notice":"GroundRules: Original legal text.
