{"data":{"id":"us-ut/utah-code-40-8-5.5","jurisdiction":"us-ut","citation":"Utah Code § 40-8-5.5","heading":"Fast track permitting for critical minerals.","body":"(1) As used in this section:\n(a) \"Critical mineral\" means the same as that term is defined in Section 79-10-101.\n(b) \"Critical minerals project\" means an activity requiring one or more state permits related to the extraction or processing of a critical mineral.\n(c) \"Critical minerals zone\" means the same as that term is defined in Section 79-10-101.\n(d) \"Permit\" means the same as that term is defined in Section 79-10-101.\n(2)\n(a) The division shall prioritize division resources to process a permit that is:\n(i) requested to be issued by the division; and\n(ii) related to a critical minerals project described in Subsection (2)(b).\n(b) This Subsection (2) applies to a critical minerals project that is:\n(i) for the extraction or processing of a critical mineral within a critical minerals zone; or\n(ii) included in the strategic plan developed by the Critical Minerals Council under Subsection 79-10-302(1).\n(3) The division shall work cooperatively with the Department of Environmental Quality to develop processes under which permits for a critical minerals project described in Subsection (2)(b) that are issued by the division and the Department of Environmental Quality:\n(a) may be issued at parallel times rather than sequentially; and\n(b) minimize the need for a person to comply with duplicative, overlapping, or conflicting requirements.\n(4) Nothing in this section abrogates or interferes with the powers or duties of the Department of Environmental Quality.","path":["Title 40 Mines and Mining","Chapter 40-8 Utah Mined Land Reclamation Act"],"source_url":"https://le.utah.gov/xcode/Title40/Chapter8/40-8-S5.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"421b67f49f3803f7013f4b372f86d2cbfd8d46824a6f52efddb206708de7a4cb","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-40-8-5","next":"us-ut/utah-code-40-8-6"},"notice":"GroundRules: Original legal text.
