{"data":{"id":"us-ut/utah-code-41-3-404","jurisdiction":"us-ut","citation":"Utah Code § 41-3-404","heading":"Right of action against dealer, salesperson, crusher, body shop, or surety on bond.","body":"(1) A person may maintain an action against a dealer, crusher, or body shop on the corporate surety bond if:\n(a) the person suffers a loss or damage because of:\n(i) fraud;\n(ii) fraudulent representation; or\n(iii) a violation of Section 41-3-210; and\n(b) the loss or damage results from the action of:\n(i) a licensed dealer;\n(ii) a licensed dealer's salesperson acting on behalf of the dealer or within the scope of the salesperson's employment;\n(iii) a licensed crusher; or\n(iv) a body shop.\n(2) Successive recovery against a surety on a bond is permitted, but the total aggregate liability on the bond to all persons making claims, regardless of the number of claimants or the number of years a bond remains in force, may not exceed the amount of the bond.\n(3) A cause of action may not be maintained against any surety under any bond required under this chapter except as provided in Section 41-3-205.","path":["Title 41 Motor Vehicles","Chapter 41-3 Motor Vehicle Business Regulation Act","Part 41-3-4 Disclosure Requirements"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter3/41-3-S404.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b59cad433dcb926eb60e376e6336e05a7a14f90cddd5ce45ff42703c504523ac","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-3-403","next":"us-ut/utah-code-41-3-405"},"notice":"GroundRules: Original legal text.
