{"data":{"id":"us-ut/utah-code-41-6a-1805","jurisdiction":"us-ut","citation":"Utah Code § 41-6a-1805","heading":"Penalty for violation.","body":"(1)\n(a) A person who violates Section 41-6a-1803 is guilty of an infraction and shall be fined a maximum of $45.\n(b) Until July 1, 2018, a peace officer may not issue a citation to an individual for a violation of Section 41-6a-1803 if the person has not previously been warned for a violation of Section 41-6a-1803 but shall issue the individual a warning informing the individual that operating or being a passenger in a vehicle without wearing a properly adjusted and fastened safety belt is prohibited.\n(c) The court shall waive all of the fine for a first violation of Subsection 41-6a-1803(1)(a)(ii) if the person submits proof of acquisition, rental, or purchase of a child restraint device.\n(2) Points for a motor vehicle reportable violation, as defined under Section 53-3-102, may not be assessed against a person for a violation of Section 41-6a-1803.","path":["Title 41 Motor Vehicles","Chapter 41-6a Traffic Code","Part 41-6a-18 Motor Vehicle Safety Belt Usage Act"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter6a/41-6a-S1805.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"b3860bf80e91406cc5b1c678ff32bfe94db6a3b1a292160f51a591a0d34edeb1","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-6a-1804","next":"us-ut/utah-code-41-6a-1806"},"notice":"GroundRules: Original legal text.
