{"data":{"id":"us-ut/utah-code-41-6a-510","jurisdiction":"us-ut","citation":"Utah Code § 41-6a-510","heading":"Local DUI and related ordinances and reckless driving and impaired driving ordinances -- Consistent with code.","body":"(1) An ordinance adopted by a local authority that governs the following matters shall be consistent with the provisions in this code which govern the following matters:\n(a) a person's operating or being in actual physical control of a motor vehicle while having alcohol in the blood or while under the influence of alcohol or any drug or the combined influence of alcohol and any drug; or\n(b) in relation to any of the matters described in Subsection (1)(a), the use of:\n(i) a chemical test or chemical tests;\n(ii) evidentiary presumptions;\n(iii) penalties; or\n(iv) any combination of the matters described in Subsection (1).\n(2) An ordinance adopted by a local authority that governs reckless driving, impaired driving, or operating a vehicle in willful or wanton disregard for the safety of persons or property shall be consistent with the provisions of this code which govern those matters.","path":["Title 41 Motor Vehicles","Chapter 41-6a Traffic Code","Part 41-6a-5 Driving Under the Influence and Reckless Driving"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter6a/41-6a-S510.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"a14ed3bcfcdd749e1f437d6452111fff1bdbd70022248111d1b2c3c2fd022d6c","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-6a-509","next":"us-ut/utah-code-41-6a-511"},"notice":"GroundRules: Original legal text.
