{"data":{"id":"us-ut/utah-code-41-6a-513","jurisdiction":"us-ut","citation":"Utah Code § 41-6a-513","heading":"Acceptance of plea of guilty to DUI -- Restrictions -- Verification of prior violations -- Prosecutor to examine defendant's record.","body":"(1) An entry of a plea of guilty or no contest to a criminal charge under Section 41-6a-502 is invalid unless the prosecutor agrees to the plea:\n(a) in open court;\n(b) in writing; or\n(c) by another means of communication which the court finds adequate to record the prosecutor's agreement.\n(2)\n(a) Prior to agreeing to a plea of guilty or no contest under Subsection (1), the prosecutor shall examine the criminal history or driver license record of the defendant to determine if the defendant's record contains a conviction, arrest, or charge for:\n(i) more than one prior violation within the previous 10 years of any offense that, if the defendant were convicted, would qualify as a conviction as defined in Subsection 41-6a-501(2);\n(ii) a felony violation of:\n(A) Section 41-6a-502; or\n(B) Section 76-5-102.1; or\n(iii) a violation of Section 76-5-207.\n(b) If the defendant's record contains a conviction or unresolved arrest or charge for an offense listed in Subsection (2)(a), a plea may only be accepted if:\n(i) approved by:\n(A) a district attorney;\n(B) a deputy district attorney;\n(C) a county attorney;\n(D) a deputy county attorney;\n(E) the attorney general; or\n(F) an assistant attorney general; and\n(ii) the attorney giving approval under Subsection (2)(b)(i) has felony jurisdiction over the case.","path":["Title 41 Motor Vehicles","Chapter 41-6a Traffic Code","Part 41-6a-5 Driving Under the Influence and Reckless Driving"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter6a/41-6a-S513.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f402273e016bf8b1d97f4855258004f3a9f376e668d35148951ec835866f5327","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-6a-512","next":"us-ut/utah-code-41-6a-514"},"notice":"GroundRules: Original legal text.
