{"data":{"id":"us-ut/utah-code-41-6a-531","jurisdiction":"us-ut","citation":"Utah Code § 41-6a-531","heading":"Access to DUI investigative reports.","body":"(1) As used in this section:\n(a) \"Agent\" means a person's attorney that has been formally engaged.\n(b) \"DUI investigative report\" means all materials that a peace officer gathers as part of investigating an offense described in Subsection 41-6a-501 including:\n(i) the identity of witnesses and, if known, contact information;\n(ii) witness statements;\n(iii) photographs and videotapes;\n(iv) diagrams;\n(v) field notes;\n(vi) test results; and\n(vii) any Targeted Responsibility for Alcohol Connected Emergencies investigation report.\n(2)\n(a) Upon request, a law enforcement agency shall disclose an unredacted DUI investigative report to:\n(i) a person who suffers loss or injury related to the person's actions that gave rise to the investigation; or\n(ii) an agent, parent, or legal guardian of the person described in Subsection (2)(a)(i).\n(b) A law enforcement agency responding to a request under Subsection (2)(a) may:\n(i) withhold a portion of the DUI investigative report if disclosure would materially prejudice an ongoing criminal investigation or criminal prosecution;\n(ii) redact or withhold any privileged information;\n(iii) redact an individual's phone number or address, if disclosure of the individual's phone number or address may endanger an individual's physical safety; or\n(iv) provide the DUI investigative report subject to an agreement that limits the recipient's use of the DUI investigative report to use solely for the purpose of pursuing a civil claim related to the incident.\n(3) A law enforcement agency may charge a reasonable fee to cover the cost incurred by disclosing a DUI investigative report in accordance with this section.","path":["Title 41 Motor Vehicles","Chapter 41-6a Traffic Code","Part 41-6a-5 Driving Under the Influence and Reckless Driving"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter6a/41-6a-S531.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"386160a02df72da570a7333e4342017ac6f6ca08e932e075f8795dbb32ec0214","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-6a-530","next":"us-ut/utah-code-41-6a-532"},"notice":"GroundRules: Original legal text.
