{"data":{"id":"us-ut/utah-code-41-6a-706.5","jurisdiction":"us-ut","citation":"Utah Code § 41-6a-706.5","heading":"Definitions -- Operation of motor vehicle near a vulnerable user of a highway prohibited -- Endangering a vulnerable user of a highway prohibited.","body":"(1) As used in this section, \"vulnerable user of a highway\" means:\n(a) a pedestrian, including a person engaged in work upon a highway or upon utilities facilities along a highway or providing emergency services within the right-of-way of a highway;\n(b) a person riding an animal; or\n(c) a person operating any of the following on a highway:\n(i) a farm tractor or implement of husbandry, without an enclosed shell;\n(ii) a skateboard;\n(iii) roller skates;\n(iv) in-line skates;\n(v) a bicycle;\n(vi) an electric assisted bicycle;\n(vii) an electric personal assistive mobility device;\n(viii) a high power electric device;\n(ix) a moped;\n(x) a motor assisted scooter;\n(xi) a motorcycle;\n(xii) a manual wheelchair; or\n(xiii) a golf cart.\n(2) An operator of a motor vehicle may not knowingly, intentionally, or recklessly:\n(a) operate a motor vehicle within three feet of a vulnerable user of a highway;\n(b) distract or attempt to distract a vulnerable user of a highway for the purpose of causing violence or injury to the vulnerable user of a highway;\n(c) force or attempt to force a vulnerable user of a highway off of the roadway for a purpose unrelated to public safety; or\n(d) cause a motor vehicle to emit an excessive amount of exhaust in a manner that distracts or endangers a vulnerable user of a highway.\n(3)\n(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is an infraction.\n(b) A violation of Subsection (2) that results in bodily injury to the vulnerable user of a highway is a class C misdemeanor.","path":["Title 41 Motor Vehicles","Chapter 41-6a Traffic Code","Part 41-6a-7 Driving on Right Side of Highway and Passing"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter6a/41-6a-S706.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"d73ebc919e5a29a6478f6631a6f6d7189b92ba4e3989a4e14e50df6d64c93007","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-6a-706","next":"us-ut/utah-code-41-6a-707"},"notice":"GroundRules: Original legal text.
