{"data":{"id":"us-ut/utah-code-41-8-4","jurisdiction":"us-ut","citation":"Utah Code § 41-8-4","heading":"Operation of a vehicle by a person under 18 -- Use of wireless telephones prohibited -- Exceptions -- Penalty.","body":"(1) Except as provided in Subsection (2), a person younger than 18 years of age, whether a resident or nonresident of this state, may not use a wireless telephone to communicate with another person while operating a motor vehicle upon a highway of this state.\n(2) It is an affirmative defense to a violation of this section that a person younger than 18 years of age was using a wireless telephone while operating a motor vehicle:\n(a) during a medical emergency;\n(b) when reporting a safety hazard or requesting assistance relating to a safety hazard;\n(c) when reporting a criminal activity or requesting assistance relating to a criminal activity; or\n(d) when communicating with a parent or legal guardian.\n(3) A person who violates this section is guilty of an infraction and shall be fined a maximum of $25.\n(4)\n(a) A violation of this section is not a reportable violation.\n(b) The Driver License Division may not assess points under Section 53-3-221 against the driving record of the person who violates this section.","path":["Title 41 Motor Vehicles","Chapter 41-8 Driving by Minors"],"source_url":"https://le.utah.gov/xcode/Title41/Chapter8/41-8-S4.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"be41d346b360db8fc3e327b805359c8f94d2e1785a5d7d5b4c44a19d5942a830","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-41-8-3","next":"us-ut/utah-code-41-10-1"},"notice":"GroundRules: Original legal text.
