{"data":{"id":"us-ut/utah-code-46-1-4","jurisdiction":"us-ut","citation":"Utah Code § 46-1-4","heading":"Bond.","body":"(1) A notarial commission is not effective until:\n(a) the notary named in the commission takes a constitutional oath of office and files a $5,000 bond with the lieutenant governor that:\n(i) a licensed surety executes for a term of four years beginning on the commission's effective date and ending on the commission's expiration date; and\n(ii) conditions payment of bond funds to any person upon the notary's misconduct while acting in the scope of the notary's commission; and\n(b) the lieutenant governor approves the oath and bond described in Subsection (1)(a).\n(2) In addition to the requirements described in Subsection (1), a remote notary certification described in Section 46-1-3.5 is not effective until:\n(a) the notary named in the remote notary certification files with the lieutenant governor evidence that the notary has obtained $5,000 of bond coverage, in addition to the bond coverage described in Subsection (1)(a), that:\n(i) a licensed surety executes for a term that begins on the certification's effective date and ends on the remote notary's commission's expiration date; and\n(ii) conditions payment of bond funds to any person upon the remote notary's misconduct while acting in the scope of the remote notary's commission; and\n(b) the lieutenant governor approves the additional bond coverage described in Subsection (2)(a).","path":["Title 46 Notarization and Authentication of Documents, Electronic Signatures, and Legal Material","Chapter 46-1 Notaries Public Reform Act"],"source_url":"https://le.utah.gov/xcode/Title46/Chapter1/46-1-S4.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"208cb5355feb18018d5e3a0328ac369851fab8fdfeb2639fd10b69d704e0935e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-46-1-3.7","next":"us-ut/utah-code-46-1-6"},"notice":"GroundRules: Original legal text.
