{"data":{"id":"us-ut/utah-code-49-12-407","jurisdiction":"us-ut","citation":"Utah Code § 49-12-407","heading":"Annual cost-of-living adjustment.","body":"(1) The office shall make an annual cost-of-living adjustment to:\n(a) an original allowance paid under Section 49-12-402 or 49-12-404, if the allowance has been paid for at least one year; and\n(b) an original payment made to an alternate payee under a domestic relations order, if the payment is to be paid as a percentage of the allowance rather than a specific dollar amount.\n(2)\n(a) The original allowance shall be increased by the annual increase in the Consumer Price Index up to a maximum of 4%.\n(b) Annual increases in the Consumer Price Index in excess of 4% shall be accumulated and used in subsequent adjustments when the annual increase in the Consumer Price Index is less than 4%.\n(3) The Consumer Price Index used in calculating adjustments shall be a United States Bureau of Labor Statistics Consumer Price Index average as determined by the board.\n(4) The cost-of-living adjustment made under this section may not decrease the allowance.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-12 Public Employees' Contributory Retirement Act","Part 49-12-4 Defined Benefit"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter12/49-12-S407.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"747f0fdaf951cd8cfd50fc06187d32d4d4f9c3d55d44fb97361920d5950076b6","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-12-406","next":"us-ut/utah-code-49-12-408"},"notice":"GroundRules: Original legal text.
