{"data":{"id":"us-ut/utah-code-49-13-407","jurisdiction":"us-ut","citation":"Utah Code § 49-13-407","heading":"Annual cost-of-living adjustment.","body":"(1) The office shall make an annual cost-of-living adjustment to:\n(a) an original allowance paid under Section 49-13-402 or 49-13-405, if the allowance has been paid for at least one year; and\n(b) an original payment made to an alternate payee under a domestic relations order, if the payment is to be paid as a percentage of the allowance rather than a specific dollar amount.\n(2)\n(a) The original allowance shall be increased by the annual increase in the Consumer Price Index up to a maximum of 4%.\n(b) Annual increases in the Consumer Price Index in excess of 4% shall be accumulated and used in subsequent adjustments when the annual increase in the Consumer Price Index is less than 4%.\n(3) The Consumer Price Index used in calculating adjustments shall be a United States Bureau of Labor Statistics Consumer Price Index average as determined by the board.\n(4) The cost-of-living adjustment made under this section may not decrease the allowance.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-13 Public Employees' Noncontributory Retirement Act","Part 49-13-4 Defined Benefit"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter13/49-13-S407.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"dda997afd01ff1a23a4b20919d278ddfa5abdc1123b0050467b8a854fd9a99e0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-13-406","next":"us-ut/utah-code-49-13-408"},"notice":"GroundRules: Original legal text.
