{"data":{"id":"us-ut/utah-code-49-17-405","jurisdiction":"us-ut","citation":"Utah Code § 49-17-405","heading":"Annual cost-of-living adjustment.","body":"(1) The office shall make an annual cost-of-living adjustment to:\n(a) an allowance paid under Section 49-17-402 and Part 5, Death Benefit, of this chapter if the benefit has been paid for at least one year; and\n(b) a payment made to an alternate payee under a domestic relations order, if the payment is to be paid as a percentage of the allowance rather than a specific dollar amount.\n(2)\n(a) The allowance shall be increased by the annual increase in the Consumer Price Index up to a maximum of 4%.\n(b) Annual increases in the Consumer Price Index in excess of 4% shall be accumulated and used in subsequent adjustments when the annual increase in the Consumer Price Index is less than 4%.\n(3) The Consumer Price Index used in calculating adjustments shall be a United States Bureau of Labor Statistics Consumer Price Index average as determined by the board.\n(4) The cost-of-living adjustment made under this section may not decrease the allowance.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-17 Judges' Contributory Retirement Act","Part 49-17-4 Defined Benefit"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter17/49-17-S405.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e646e355be308e578a7bd532460a2ae6a7ea2584b6be380fbaa17efb3f9c724e","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-17-404","next":"us-ut/utah-code-49-17-501"},"notice":"GroundRules: Original legal text.
