{"data":{"id":"us-ut/utah-code-49-17-501","jurisdiction":"us-ut","citation":"Utah Code § 49-17-501","heading":"Death benefit for members before retirement -- Computation.","body":"(1) Upon the receipt of acceptable proof of death of a member before the member's retirement date, the member's surviving spouse shall have the choice of the following death benefits:\n(a) a refund of the member's member contributions, including refund interest, plus 65% of the member's most recent 12 months' compensation prior to death; or\n(b) an allowance equal to 65% of the allowance computed in accordance with Section 49-17-402, but disregarding early retirement reductions.\n(2) If there is no surviving spouse, member contributions, including refund interest, shall be refunded to a beneficiary, in accordance with Sections 49-11-609 and 49-11-610.\n(3)\n(a) A surviving spouse who requests a benefit under this section shall apply in writing to the office.\n(b) The allowance shall begin on the first day of the month:\n(i) following the month in which the member died, if the application is received by the office within 90 days of the member's death; or\n(ii) following the month in which the application is received by the office, if the application is received by the office more than 90 days after the member's death.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-17 Judges' Contributory Retirement Act","Part 49-17-5 Death Benefit"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter17/49-17-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"47612a59e38aebe9a8ab2082a233b0085216778ea5a20048ac9b832bef1ed1cd","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-17-405","next":"us-ut/utah-code-49-17-502"},"notice":"GroundRules: Original legal text.
