{"data":{"id":"us-ut/utah-code-49-19-201","jurisdiction":"us-ut","citation":"Utah Code § 49-19-201","heading":"Plan participation -- Eligibility.","body":"(1) A governor or legislator is eligible for service credit in this plan during their term of service in their elected position if the governor or legislator:\n(a) entered office before July 1, 2011; or\n(b) accrued service credit in a Tier I system or plan administered by the board before July 1, 2011.\n(2) A governor or legislator initially entering office on or after July 1, 2011, who does not have service credit accrued before July 1, 2011, in a Tier I system or plan administered by the board:\n(a) may not participate in this system;\n(b) is only eligible to participate in the Tier II Defined Contribution Plan established under Chapter 22, Part 4, Tier II Defined Contribution Plan; and\n(c) is not eligible to participate in the Tier II hybrid retirement system established under Chapter 22, Part 3, Tier II Hybrid Retirement System.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-19 Utah Governors' and Legislators' Retirement Act","Part 49-19-2 Membership Eligibility"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter19/49-19-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"2edcdab4c512ea2d569c4c546636f59e35939806886b5144e7d0d2ee5568f1c7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-19-104","next":"us-ut/utah-code-49-19-301"},"notice":"GroundRules: Original legal text.
