{"data":{"id":"us-ut/utah-code-49-23-202","jurisdiction":"us-ut","citation":"Utah Code § 49-23-202","heading":"Participation of employers -- Admission requirements.","body":"(1)\n(a) An employer is a participating employer and may not withdraw from participation in this system.\n(b) A participating employer shall cover the participating employer's:\n(i) public safety service employees in accordance with Section 49-15-202; and\n(ii) firefighter service employees in accordance with Section 49-16-202.\n(2)\n(a) An employer may, by resolution of the employer's governing body, apply for admission to this system.\n(b) Upon approval of the resolution by the board, the employer is a participating employer in this system and is subject to this title.\n(3) If a participating employer purchases service credit on behalf of a public safety service employee or a firefighter service employee for service rendered prior to the participating employer's admission to this system, the participating employer shall:\n(a) purchase service credit in a nondiscriminatory manner on behalf of all current and former public safety service employees or firefighter service employees who were eligible for service credit at the time service was rendered; and\n(b) comply with the provisions of Section 49-11-403.","path":["Title 49 Utah State Retirement and Insurance Benefit Act","Chapter 49-23 New Public Safety and Firefighter Tier II Contributory Retirement Act","Part 49-23-2 Membership Eligibility"],"source_url":"https://le.utah.gov/xcode/Title49/Chapter23/49-23-S202.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6cd7da903a4331bc71dc2cb7ffe25e45fabee8793973a6a27d8b1bff01462d46","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-49-23-201","next":"us-ut/utah-code-49-23-203"},"notice":"GroundRules: Original legal text.
