{"data":{"id":"us-ut/utah-code-52-3-4","jurisdiction":"us-ut","citation":"Utah Code § 52-3-4","heading":"Exceptions in towns and rural areas.","body":"(1) In a town, as defined in Section 10-1-104, this chapter shall not apply to the employment of uncles, aunts, nephews, nieces, or cousins.\n(2) This chapter shall not apply to the employment of a relative if:\n(a) fewer than 3,000 people live within 40 miles of the primary place of employment, measured over all weather public roads;\n(b) the job opening has had reasonable public notice; and\n(c) the relative is the best qualified candidate for the position.\n(3) In any proceeding challenging the hiring of a relative under the exception in Subsection (2), the employer has the burden of establishing each of the criteria provided in Subsections (2)(a) through (c).","path":["Title 52 Public Officers","Chapter 52-3 Prohibiting Employment of Relatives"],"source_url":"https://le.utah.gov/xcode/Title52/Chapter3/52-3-S4.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6d4a0e7751c8919a57b5e23271965e3516a3774cb20c68013977a61c6ba479a5","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-52-3-3","next":"us-ut/utah-code-52-4-101"},"notice":"GroundRules: Original legal text.
