{"data":{"id":"us-ut/utah-code-53-22-108","jurisdiction":"us-ut","citation":"Utah Code § 53-22-108","heading":"School safety foundation.","body":"(1) As used in this section:\n(a) \"Authorized foundation\" means a nonprofit foundation that:\n(i) meets the requirements of this section; and\n(ii) the state security chief authorizes in consultation with the School Safety Center created in Section 53G-8-802.\n(b) \"School safety product\" means equipment, technology, service, or material that enhances school safety and security.\n(2) The state security chief may approve a nonprofit foundation to be an authorized foundation if the foundation:\n(a) maintains status as a nonprofit organization under 26 U.S.C. Sec. 501(c)(3);\n(b) has operated continuously in the state for three or more years;\n(c) maintains a primary mission focused on school safety;\n(d) operates under a board of directors that includes:\n(i) a law enforcement representative;\n(ii) an educator or school administrator; and\n(iii) an emergency management professional;\n(e) demonstrates financial stability through:\n(i) an annual independent audit;\n(ii) maintained reserves; and\n(iii) a clean financial record; and\n(f) provides evidence of:\n(i) successful project management;\n(ii) an existing relationship with an educational institution; and\n(iii) knowledge of school safety requirements described in federal and state law.\n(3) A foundation seeking authorization shall submit to the state security chief:\n(a) a written application that demonstrates compliance with Subsection (2);\n(b) a financial record for the previous three years;\n(c) a current board member qualification;\n(d) a proposed school safety initiative; and\n(e) an internal procurement policy for purchases not made from a state cooperative contract.\n(4) The state security chief shall:\n(a) review an application within 60 days;\n(b) request additional information if needed;\n(c) issue a written decision; and\n(d) maintain a public record of an authorized foundation, including records related to the approval process of an authorized foundation.\n(5) An authorized foundation may:\n(a) use a state cooperative contract in accordance with Section 63G-6a-2105;\n(b) make a bulk purchase of a school safety product; and\n(c) in coordination with the state security chief and the School Safety Center:\n(i) facilitate a donation of a school safety product; and\n(ii) distribute a product to a school.\n(6) An authorized foundation shall:\n(a) follow Title 63G, Chapter 6a, Utah Procurement Code, when utilizing a state cooperative contract;\n(b) maintain separate accounting for a school safety purchase;\n(c) by August 1 of each year, submit an annual report to the state security chief that includes:\n(i) any product procured through a state cooperative contract;\n(ii) the annual independent audit required in Subsection (2)(e);\n(iii) all schools served;\n(iv) the total value of a donation facilitated; and\n(v) a compliance certification; and\n(d) renew authorization every three years.\n(7) The state security chief:\n(a) may revoke authorization if the authorized foundation:\n(i) fails to maintain a requirement of this section;\n(ii) engages in financial mismanagement; or\n(iii) submits false information in a report required by this section; and\n(b) shall, before revoking authorization:\n(i) provide written notice to the foundation;\n(ii) allow a 30-day period to remedy the violation;\n(iii) provide an opportunity for a hearing; and\n(iv) issue a final written decision.\n(8) Authorization under this section does not:\n(a) create state liability;\n(b) imply state endorsement;\n(c) override a local procurement requirement; and\n(d) exempt the foundation from an applicable law.","path":["Title 53 Public Safety Code","Chapter 53-22 School Security Act"],"source_url":"https://le.utah.gov/xcode/Title53/Chapter22/53-22-S108.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"f5eddb86e49584ba580d17963e94830d49fde63c9e4ec9c367e8a4346b2c342b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53-22-107","next":"us-ut/utah-code-53-22-109"},"notice":"GroundRules: Original legal text.
