{"data":{"id":"us-ut/utah-code-53-3-502","jurisdiction":"us-ut","citation":"Utah Code § 53-3-502","heading":"Definitions.","body":"As used in this part:\n(1)\n(a) \"Commercial driver training school\" or \"school\" means a business enterprise conducted by an individual, association, partnership, or corporation for the education and training of persons, either practically or theoretically, or both, to:\n(i) drive motor vehicles, including motorcycles; and\n(ii) prepare an applicant for an examination given by the state for a license or learner permit.\n(b) A commercial driver training school may charge a consideration or tuition for the services described under Subsection (1)(a).\n(2)\n(a) \"Commercial testing only school\" means a business enterprise conducted by an individual, association, partnership, or corporation that:\n(i) is designated by the division as a commercial testing only school;\n(ii) employs instructors who are certified by the division; and\n(iii) engages only in testing students for the purpose of obtaining a driver license.\n(b) A commercial testing only school may conduct behind-the-wheel or observation instruction if approved by the division.\n(c) A commercial testing only school may not engage in education or training of persons, either practically or theoretically, or both to drive motor vehicles, except when:\n(i) counseling the driver following a test in reference to errors made during the administration of the test; or\n(ii) conducting behind-the-wheel or observation instruction if approved by the division.\n(d) A commercial testing only school may not test an individual who has completed any behind-the-wheel or observation instruction through the school with which the tester is employed.\n(3) \"Instructor\" means a person, whether acting as an operator of a commercial driver training school or for a school for compensation, who:\n(a) teaches, conducts classes of, gives demonstrations to, or supervises practice of persons learning to drive motor vehicles, including motorcycles;\n(b) prepares persons to take an examination for a license or learner permit; or\n(c) supervises the work of any other instructor.\n(4) \"Observation time\" means a period of time during which a driver education student observes another student, instructor, or road user.\n(5) \"School operator\" means a person who:\n(a) is certified as an instructor;\n(b) has met the requirements for school operator status as established by the division;\n(c) is authorized or certified to operate or manage a driver training school; and\n(d) may supervise the work of another instructor.","path":["Title 53 Public Safety Code","Chapter 53-3 Uniform Driver License Act","Part 53-3-5 Commercial Driver Training Schools Act"],"source_url":"https://le.utah.gov/xcode/Title53/Chapter3/53-3-S502.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4d8bd5db85cb4b5c4d2a3acb97567c21a1e6220666286a93512473788b02077d","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53-3-501","next":"us-ut/utah-code-53-3-503"},"notice":"GroundRules: Original legal text.
