{"data":{"id":"us-ut/utah-code-53-5a-604","jurisdiction":"us-ut","citation":"Utah Code § 53-5a-604","heading":"Penalties.","body":"(1) A dealer is guilty of a class A misdemeanor if the dealer willfully and intentionally:\n(a) requests, obtains, or seeks to obtain criminal history background information under false pretenses;\n(b) disseminates criminal history background information; or\n(c) violates Section 53-5a-602.\n(2) An individual who purchases or transfers a firearm is guilty of a third degree felony if the individual willfully and intentionally makes a false statement of the information required for a criminal background check in Section 53-5a-602.\n(3) Except as otherwise provided in Subsection (1), a dealer is guilty of a third degree felony if the dealer willfully and intentionally sells or transfers a firearm in violation of this part or Title 76, Chapter 11, Weapons.\n(4) An individual is guilty of a third degree felony if the individual purchases a firearm with the intent to:\n(a) resell or otherwise provide a firearm to an individual who is ineligible to purchase or receive a firearm from a dealer; or\n(b) transport a firearm out of this state to be resold to an ineligible individual.","path":["Title 53 Public Safety Code","Chapter 53-5a Firearm Laws","Part 53-5a-6 Sale and Purchase of a Firearm"],"source_url":"https://le.utah.gov/xcode/Title53/Chapter5a/53-5a-S604.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"069928e49d81b0cfc5c863594515e2bce1252dc7d8b43633b70a23ba18e8a327","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53-5a-603","next":"us-ut/utah-code-53-5a-605"},"notice":"GroundRules: Original legal text.
