{"data":{"id":"us-ut/utah-code-53-7-502","jurisdiction":"us-ut","citation":"Utah Code § 53-7-502","heading":"Definitions.","body":"As used in this part:\n(1) \"Audio effect\" includes music, animal sounds, whistles, buzzers, or other noises not pertinent to the flame-producing function of the lighter.\n(2)\n(a) \"Distribute\" means to:\n(i) deliver to a person other than the purchaser; or\n(ii) provide as part of a commercial promotion or as a prize or premium.\n(b) \"Distribute\" does not include providing as a personal gift.\n(3) \"Importer\" means a person who causes a lighter to enter this state from a manufacturing, wholesale, distribution, or retail sales point outside this state:\n(a) for the purpose of selling or distributing the lighter within this state; or\n(b) with the result that the lighter is sold or distributed within this state.\n(4) \"Lighter\" means a handheld mechanical device of a type typically used for igniting tobacco products by use of a flame.\n(5) \"Misleading design\" means a lighter that:\n(a) has a shape that resembles or imitates an object other than a lighter;\n(b) may have one or more audio or visual effects; and\n(c) has other features of a type that would reasonably be expected to make the lighter appealing or attractive to a child younger than 10 years of age.\n(6) \"Novelty lighter\":\n(a) means a lighter that has:\n(i) a misleading design; and\n(ii) operates on any fuel, including butane or liquid fuel;\n(b) does not mean:\n(i) a lighter manufactured before January 1, 1980;\n(ii) a lighter that has been rendered permanently incapable of producing a flame or otherwise causing combustion; or\n(iii) a mechanical device primarily used to ignite fuel for fireplaces, or for charcoal or gas grills.\n(7) \"Sell\" means to provide or promise to provide a product to a wholesale, retail, mail-order, or other purchaser in exchange for consideration.\n(8) \"Visual effect\":\n(a) includes flashing lights, color-changing lights, or changing images; and\n(b) does not include logos, decals, decorative artwork, or heat-shrinkable sleeves.","path":["Title 53 Public Safety Code","Chapter 53-7 Utah Fire Prevention and Safety Act","Part 53-7-5 Regulation of Novelty Lighters"],"source_url":"https://le.utah.gov/xcode/Title53/Chapter7/53-7-S502.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"890f52e2b6f05f89485e655e685badcfc2380f832ffcd278a663f1d48a39f408","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53-7-501","next":"us-ut/utah-code-53-7-503"},"notice":"GroundRules: Original legal text.
