{"data":{"id":"us-ut/utah-code-53d-2-301","jurisdiction":"us-ut","citation":"Utah Code § 53D-2-301","heading":"Advocacy office governance -- State treasurer role and duties.","body":"(1) The advocacy council, established in Section 53D-2-302, and the state treasurer govern the advocacy office with separate and distinct responsibilities enumerated in this chapter.\n(2) The state treasurer, acting in a fiduciary capacity to the trust beneficiaries, shall:\n(a) appoint an advocacy director, as provided in Section 53D-2-401;\n(b) oversee and provide administrative support to the advocacy office;\n(c) verify compliance with reporting requirements for the advocacy director;\n(d) submit an advocacy office budget to the Legislature; and\n(e) have authority to approve a requested reduction in the annual distribution for an institutional beneficiary under the conditions described in Subsection 53D-2-501(4)(f), after consultation with the trust beneficiary and the advocacy director.\n(3) A cause of action may not be maintained against the state treasurer for an act or omission made in the course of exercising a duty under this chapter if:\n(a) the act or omission is taken in good faith; and\n(b) the act or omission is taken in a manner the treasurer reasonably believes to be in the best interests of the trust beneficiaries.","path":["Title 53D School and Institutional Trust Fund Management and Land Trusts Protection and Advocacy Office","Chapter 53D-2 School And Institutional Trust Beneficiaries' Advocacy Act","Part 53D-2-3 School And Institutional Beneficiaries' Advocacy Office Governance"],"source_url":"https://le.utah.gov/xcode/Title53D/Chapter2/53D-2-S301.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"fcc2bf4ab4c5396ad5060c771a963c80e4aa72a78beb0fd18dedd59a0f850f45","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53d-2-202","next":"us-ut/utah-code-53d-2-302"},"notice":"GroundRules: Original legal text.
