{"data":{"id":"us-ut/utah-code-53e-3-1309","jurisdiction":"us-ut","citation":"Utah Code § 53E-3-1309","heading":"Declaring conflicts of interest.","body":"(1) As used in this section, \"conflict of interest disclosure\" means the same as that term is defined in Section 20A-11-1602.\n(2) A board member shall file a conflict of interest disclosure by complying with the requirements of Title 20A, Chapter 11, Part 16, Conflict of Interest Disclosures.\n(3) Board staff shall ensure that a link to a board member's conflict of interest disclosure is available to the public on the board's website.\n(4) If a board member has actual knowledge that the board member has a conflict of interest that is not stated on the board member's financial disclosure form filed under Subsection (2), that board member shall, before or during a vote on any matter before the board, orally declare to the board:\n(a) that the board member may have a conflict of interest; and\n(b) what that conflict is.\n(5) A verbal declaration of a conflict of interest under Subsection (4) shall be recorded in the minutes of the meeting.\n(6) The requirements of this section do not prohibit a board member from voting on any matter before the board.","path":["Title 53E Public Education System -- State Administration","Chapter 53E-3 State Board of Education Organization, Powers, and Duties","Part 53E-3-13 State Board Member Ethics And Adjudication Of Ethics Complaints"],"source_url":"https://le.utah.gov/xcode/Title53E/Chapter3/53E-3-S1309.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"4e6e600c5ef3795e3b8555575b0c22a10fb2421ea73964338ace2b405e62aeb2","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53e-3-1308","next":"us-ut/utah-code-53e-3-1310"},"notice":"GroundRules: Original legal text.
