{"data":{"id":"us-ut/utah-code-53e-3-1314","jurisdiction":"us-ut","citation":"Utah Code § 53E-3-1314","heading":"Attorney fees and costs.","body":"(1) A person filing a complaint under this part:\n(a) may, but is not required to, retain legal representation during the complaint review process; and\n(b) is responsible for payment of complainants' attorney fees and costs incurred.\n(2)\n(a) A board member against whom a complaint is filed under this part:\n(i) may, but is not required to, retain legal representation during the complaint review process; and\n(ii) is responsible for that board member's own attorney fees and costs involved, except as provided in Subsection (2)(b).\n(b) The board shall pay the reasonable attorney fees and costs incurred by a board member against whom a complaint is filed under this part if:\n(i) the commission declines to recommend that any allegation in the complaint be reviewed by the board; or\n(ii) the board determines that none of the allegations in the complaint that were recommended for review by the commission have been proved.\n(3)\n(a) An attorney participating in a hearing before the commission or the board shall comply with:\n(i) the Rules of Professional Conduct established by the Utah Supreme Court;\n(ii) the procedures and requirements of this part; and\n(iii) the directions of the chairs, commission, and board.\n(b) Violations of Subsection (3)(a) may constitute:\n(i) contempt, subject to enforcement as provided in Section 53E-3-1311; or\n(ii) a violation of the Rules of Professional Conduct subject to enforcement by the Utah State Bar.","path":["Title 53E Public Education System -- State Administration","Chapter 53E-3 State Board of Education Organization, Powers, and Duties","Part 53E-3-13 State Board Member Ethics And Adjudication Of Ethics Complaints"],"source_url":"https://le.utah.gov/xcode/Title53E/Chapter3/53E-3-S1314.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"14e7be4000c384e1909ff065a9e2f435292927943e3a4ecef73e46ed93e43a77","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53e-3-1313","next":"us-ut/utah-code-53e-3-1315"},"notice":"GroundRules: Original legal text.
