{"data":{"id":"us-ut/utah-code-53e-6-402","jurisdiction":"us-ut","citation":"Utah Code § 53E-6-402","heading":"State board-required licensing or employment recommendations -- Local public school-required licensing recommendations -- Notice requirements for affected parties -- Exemption from liability.","body":"(1)\n(a) The state board shall provide the appropriate administrator of a public or private school or of an agency outside the state that is responsible for licensing or certifying educational personnel with a recommendation or other information possessed by the state board that has significance in evaluating the employment or license of:\n(i) a current or prospective school employee;\n(ii) an educator or education license holder; or\n(iii) a license applicant.\n(b) Information supplied under Subsection (1)(a) shall include:\n(i) the complete record of a hearing; and\n(ii) the investigative report for matters that:\n(A) the educator has had an opportunity to contest; and\n(B) did not proceed to a hearing.\n(2) At the request of the state board, an administrator of a public school or school district shall, and an administrator of a private school may, provide the state board with a recommendation or other information possessed by the school or school district that has significance in evaluating the:\n(a) license of an educator or education license holder; or\n(b) potential licensure of a license applicant.\n(3) If the state board decides to deny licensure or to take action against an educator's license based upon information provided under this section, the state board shall:\n(a) give notice of the information to the educator or license applicant; and\n(b) afford the educator or license applicant an opportunity to respond to the information.\n(4) A person who, in good faith, provides a recommendation or discloses or receives information under this section is exempt from civil and criminal liability relating to that recommendation, receipt, or disclosure.","path":["Title 53E Public Education System -- State Administration","Chapter 53E-6 Education Professional Licensure","Part 53E-6-4 Background and Employment Checks"],"source_url":"https://le.utah.gov/xcode/Title53E/Chapter6/53E-6-S402.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6a58fe82369caa939412d3ad45bf299524e3a813cae50e32b2ffcc9c89d6e4b0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53e-6-401","next":"us-ut/utah-code-53e-6-403"},"notice":"GroundRules: Original legal text.
