{"data":{"id":"us-ut/utah-code-53f-4-518","jurisdiction":"us-ut","citation":"Utah Code § 53F-4-518","heading":"Small school student access to courses.","body":"Subject to legislative appropriations and Subsection 53F-4-514(2), and notwithstanding Subsections 53F-4-509(2) and (3), the state board shall:\n(1) use funds from an appropriation for the Statewide Online Education Program to pay for an online course fee described in Section 53F-4-505 for a student who is enrolled in a public high school that enrolls fewer than 1,000 students;\n(2) after the funds described in Subsection (1) have been expended, make a deduction as described in Subsection 53F-4-507(3);\n(3) establish a prioritized funding distribution system that evaluates and ranks schools based on:\n(a) the school's demonstrated inability to provide courses, including Advanced Placement, International Baccalaureate, or Concurrent Enrollment due to:\n(i) insufficient student enrollment to justify full course sections;\n(ii) geographic isolation from qualified instructors;\n(iii) limited staff capacity to teach courses; or\n(iv) financial constraints in hiring qualified instructors; and\n(b) the school's current access to college and career readiness programming;\n(4) develop an annual assessment process to:\n(a) identify schools with the highest demonstrated need based on the criteria in Subsection (3); and\n(b) adjust funding priorities based on program outcomes;\n(5) establish reporting requirements for recipient schools to:\n(a) document the use of allocated funds;\n(b) track student participation in online courses;\n(c) measure student achievement in funded courses; and\n(d) demonstrate ongoing need for continued funding; and\n(6) at the request of the Education Interim Committee, submit a report that includes:\n(a) a list of schools receiving prioritized funding;\n(b) the basis for funding prioritization;\n(c) student participation and achievement data; and\n(d) recommendations for program improvement.","path":["Title 53F Public Education System -- Funding","Chapter 53F-4 State Funding -- Contracted Initiatives","Part 53F-4-5 Statewide Online Education Program"],"source_url":"https://le.utah.gov/xcode/Title53F/Chapter4/53F-4-S518.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"3e981da0336f7f4f1d5a694143bfa78f784b7f1a5386f9cecbf9d18018145710","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53f-4-517","next":"us-ut/utah-code-53f-4-519"},"notice":"GroundRules: Original legal text.
