{"data":{"id":"us-ut/utah-code-53f-6-413","jurisdiction":"us-ut","citation":"Utah Code § 53F-6-413","heading":"Legal proceedings.","body":"(1) In any legal proceeding against the state in which a qualifying provider challenges the application of this part to the qualifying provider, the state shall bear the burden of establishing that the law:\n(a) is necessary; and\n(b) does not impose an undue burden on the qualifying provider.\n(2) The following bear no liability based on the award or use of scholarship funds under this part:\n(a) the state;\n(b) the state board;\n(c) the program manager; or\n(d) an LEA.\n(3) If any provision of this part is the subject of a state or federal constitutional challenge in a state court, scholarship students and scholarship students' parents may intervene as a matter of right to defend the program's constitutionality, subject to any court order that all defending parents and scholarship students intervene jointly.","path":["Title 53F Public Education System -- Funding","Chapter 53F-6 State Funding -- Programs Administered by Other Agencies","Part 53F-6-4 Utah Fits All Scholarship Program"],"source_url":"https://le.utah.gov/xcode/Title53F/Chapter6/53F-6-S413.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"aee05cbc3aa6526ebde0fae7974d228d437afa6f75effaa317e277e8f682e1a0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53f-6-412","next":"us-ut/utah-code-53f-6-414"},"notice":"GroundRules: Original legal text.
