{"data":{"id":"us-ut/utah-code-53g-7-705","jurisdiction":"us-ut","citation":"Utah Code § 53G-7-705","heading":"Clubs -- Limitations and denials.","body":"(1) A school shall limit or deny authorization or school facilities use to a club, or require changes to the club's application before granting authorization or school facilities use:\n(a) as the school determines to be necessary to:\n(i) protect the physical, emotional, psychological, or moral well-being of students and faculty;\n(ii) maintain order and discipline on school premises;\n(iii) prevent a material and substantial interference with the orderly conduct of a school's educational activities;\n(iv) protect the rights of parents and students;\n(v) maintain the boundaries of socially appropriate behavior; or\n(vi) ensure compliance with all applicable laws, rules, regulations, and policies; or\n(b) if a club's proposed charter and proposed activities indicate students or advisors in club related activities would, as a substantial, material, or significant part of the student's or club's conduct or means of expression:\n(i) encourage criminal or delinquent conduct;\n(ii) promote bigotry;\n(iii) involve human sexuality;\n(iv) involve any effort to engage in or conduct mental health therapy, counseling, or psychological services for which a license is required under state law; or\n(v) promote or encourage a prohibited discriminatory practice.\n(2) A school has the primary authority to determine whether any club meets the criteria of Subsection (1).\n(3) If a school or LEA governing board limits or denies authorization to a club, the school or LEA governing board shall provide, in writing, to the applicant the factual and legal basis for the limitation or denial.\n(4) A student's spontaneous expression of sentiments or opinions otherwise identified in Subsection 53E-9-203(1) is not prohibited.","path":["Title 53G Public Education System -- Local Administration","Chapter 53G-7 Public School General Requirements","Part 53G-7-7 Student Clubs"],"source_url":"https://le.utah.gov/xcode/Title53G/Chapter7/53G-7-S705.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"479e410ebe0792ba5d86a70b9b28efdf999c5c7ac2e9dd042d0839787ba9a702","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53g-7-704","next":"us-ut/utah-code-53g-7-706"},"notice":"GroundRules: Original legal text.
