{"data":{"id":"us-ut/utah-code-53g-8-509.1","jurisdiction":"us-ut","citation":"Utah Code § 53G-8-509.1","heading":"Definitions for part.","body":"As used in this part:\n(1) \"Drug offense\" means an offense for:\n(a) unlawfully possessing or using a controlled substance or controlled substance analog as described in Section 76-18-207;\n(b) unlawfully producing, manufacturing, or dispensing a controlled substance or counterfeit substance as described in Section 76-18-208;\n(c) unlawfully distributing or agreeing to distribute a controlled substance or counterfeit substance as described in Section 76-18-209;\n(d) unlawfully possessing a controlled substance or counterfeit substance with intent to distribute as described in Section 76-18-210;\n(e) unlawfully engaging in a continuing criminal enterprise involving drugs as described in Section 76-18-211;\n(f) unlawfully allowing possession, use, or distribution of a controlled substance on the premises as described in Section 76-18-212;\n(g) unlawful possession of an altered or forged prescription or order for a controlled substance as described in Section 76-18-213;\n(h) unlawful use of a license number in the course of manufacturing or distributing a controlled substance as described in Section 76-18-214;\n(i) unlawful misrepresentation as an authorized person to obtain a controlled substance described in Section 76-18-215;\n(j) unlawful conduct to obtain a controlled substance as described in Section 76-18-216;\n(k) unlawfully prescribing or dispensing a controlled substance to a person known to be using unlawful means as described in Section 76-18-217;\n(l) unlawfully making, forging, altering, or uttering a prescription or a written order as described in Section 76-18-218; or\n(m) unlawful materials to create a counterfeit controlled substance as described in Section 76-18-219.\n(2) School\" means a public or private elementary or secondary school.\n(3) \"School employee\" means an individual working in the individual's capacity as:\n(a) a school teacher;\n(b) a school staff member;\n(c) a school administrator; or\n(d) an individual:\n(i) who is employed, directly or indirectly, by a school, an LEA governing board, or a school district; and\n(ii) who works on a school campus.\n(4) \"School is in session\" means the same as that term is defined in Section 53E-3-516.\n(5) \"School-sponsored activity\" means the same as that term is defined in Section 53E-3-516.","path":["Title 53G Public Education System -- Local Administration","Chapter 53G-8 Discipline and Safety","Part 53G-8-5 Notification Of Offenses At School"],"source_url":"https://le.utah.gov/xcode/Title53G/Chapter8/53G-8-S509.1.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"926824e15a5f8ff6f86fe8564a553c597ed409bdde75c2a5fc06f81cc4febe96","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53g-8-405","next":"us-ut/utah-code-53g-8-510"},"notice":"GroundRules: Original legal text.
