{"data":{"id":"us-ut/utah-code-53g-9-205.2","jurisdiction":"us-ut","citation":"Utah Code § 53G-9-205.2","heading":"Definitions -- Prohibited food additives -- Exceptions.","body":"(1) As used in this section:\n(a) \"FD\u0026C\" means the Federal Food, Drug, and Cosmetics Act, 21 C.F.R. Part 74.\n(b) \"Public school\" means the same as that term is defined in Section 53G-9-205.1.\n(c) \"School day\" means the same as that terms is defined in Section 53G-6-201.\n(2)\n(a) Beginning in the 2026-2027 school year, a public school may not sell, donate, offer, or serve on school grounds during the school day, food that contains:\n(i) potassium bromate;\n(ii) propylparaben;\n(iii) FD\u0026C Blue No. 1;\n(iv) FD\u0026C Blue No. 2;\n(v) FD\u0026C Green No. 3;\n(vi) FD\u0026C Red No. 3;\n(vii) FD\u0026C Red No. 40;\n(viii) FD\u0026C Yellow No. 5; and\n(ix) FD\u0026C Yellow No. 6.\n(b) Except as provided in Subsection (3), a person who sells, donates, offers, or serves a consumable item during the school day shall comply with the requirements under this section.\n(3)\n(a) Notwithstanding Subsection (2)(b):\n(i) a student's parent may provide students with a food item described in Subsection (2)(a) during the school day;\n(ii) a teacher may provide students with a food item described in Subsection (2)(a) if the teacher obtains permission from the students' parents at the start of each school semester; and\n(iii) a person may sell a food item described in Subsection (2)(a):\n(A) as a concession item at a school-sponsored event or extra-curricular activity; or\n(B) in a vending machine.\n(b) This section does not apply to a charter school or school district that has 5,500 students or fewer.","path":["Title 53G Public Education System -- Local Administration","Chapter 53G-9 Health and Welfare","Part 53G-9-2 Miscellaneous Requirements"],"source_url":"https://le.utah.gov/xcode/Title53G/Chapter9/53G-9-S205.2.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"e1d6a133d609d06b3fd8ef4c204a3c2c471dd1835e5ba71331299c79776d6b5b","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53g-9-205.1","next":"us-ut/utah-code-53g-9-205.3"},"notice":"GroundRules: Original legal text.
