{"data":{"id":"us-ut/utah-code-53h-13-406","jurisdiction":"us-ut","citation":"Utah Code § 53H-13-406","heading":"Cooperative education program -- Liability and risk management.","body":"(1)\n(a) The Utah System of Higher Education and participating institutions are not liable for any act, omission, or conduct of cooperative education employees or cooperative education employers.\n(b) A cooperative education employer shall indemnify and hold harmless all participating institutions against claims arising from co-op placements.\n(2) The Office of the Commissioner of Higher Education shall:\n(a) establish procedures for:\n(i) program administration;\n(ii) risk management;\n(iii) issue resolution; and\n(iv) early termination protocols; and\n(b) develop policies regarding:\n(i) liability coverage;\n(ii) workplace safety;\n(iii) co-op performance standards; and\n(iv) professional conduct requirements for a cooperative education employee.\n(3) A participating institution shall:\n(a) maintain documentation systems for:\n(i) placement agreements;\n(ii) performance reports;\n(iii) incident records; and\n(iv) program evaluations; and\n(b) implement procedures for:\n(i) issue resolution;\n(ii) performance intervention;\n(iii) placement modification; and\n(iv) program termination.\n(4) A cooperative education employer shall:\n(a) maintain appropriate insurance coverage;\n(b) in accordance with Subsection (1), indemnify participating institutions against claims arising from cooperative education placements;\n(c) regarding a cooperative education employee, notify the relevant participating institution of:\n(i) performance concerns;\n(ii) policy violations;\n(iii) workplace incidents; and\n(iv) proposed terminations; and\n(d) regarding a cooperative education employee, document and report to the relevant participating institution:\n(i) workplace injuries;\n(ii) safety incidents;\n(iii) policy violations; and\n(iv) program departures.","path":["Title 53H Higher Education","Chapter 53H-13 Workforce Development","Part 53H-13-4 Talent Connect"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter13/53H-13-S406.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"8ea8b33bba5d4b911526e90bf0a34cf3bb9dba43f0aae13ccba071b84e29e976","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-13-405","next":"us-ut/utah-code-53h-13-407"},"notice":"GroundRules: Original legal text.
