{"data":{"id":"us-ut/utah-code-53h-14-204","jurisdiction":"us-ut","citation":"Utah Code § 53H-14-204","heading":"Business confidentiality claims.","body":"(1)\n(a) Any person who provides to an institution a record that the person believes should be protected under a provision listed in Subsection 63G-2-309(1)(b)(i), restricted under Section 53H-14-202, or both protected under a provision listed in Subsection 63G-2-309(1)(b)(i) and restricted under Section 53H-14-202, shall provide the institution:\n(i) a written claim of business confidentiality; and\n(ii) a concise statement of reasons supporting the claim of business confidentiality.\n(b) The person described in Subsection (1)(a) shall make the filing at the commencement of:\n(i) the sponsored research project; or\n(ii) the technology transfer process.\n(c) A claim of business confidentiality submitted under this Subsection (1) shall cover all protected and restricted records exchanged during the:\n(i) sponsored research project; or\n(ii) technology transfer process.\n(2) The inadvertent failure to make a legally adequate claim of business confidentiality at the time required by Subsection (1) does not prejudice the claimant's right to make a legally adequate claim at a different time before disclosure of the record.","path":["Title 53H Higher Education","Chapter 53H-14 Data, Records, and Privacy","Part 53H-14-2 Restricted Records"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter14/53H-14-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"5ea2f2dda957f7bb0cbd16460003857a69ead6044ba7a25a6a2ddc4d188bde3a","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-14-203","next":"us-ut/utah-code-53h-14-205"},"notice":"GroundRules: Original legal text.
