{"data":{"id":"us-ut/utah-code-53h-14-401","jurisdiction":"us-ut","citation":"Utah Code § 53H-14-401","heading":"General provisions -- Definitions.","body":"As used in this part:\n(1) \"Certified advocate\" means an individual who:\n(a) is employed by or volunteers at a qualified institutional victim services provider;\n(b) has completed at least 40 hours of training in counseling and assisting victims of sexual harassment, sexual assault, rape, dating violence, domestic violence, or stalking; and\n(c) acts under the supervision of the director or director's designee of a qualified institutional victim services provider.\n(2)\n(a) \"Confidential communication\" means information that is communicated by a victim, in the course of the victim seeking an institutional advocacy service, to:\n(i) a certified advocate;\n(ii) a qualified institutional victim services provider;\n(iii) a person reasonably necessary for the transmission of the information;\n(iv) an individual who is present at the time the information is transmitted for the purpose of furthering the victim's interests; or\n(v) another individual, in the context of group counseling at a qualified institutional victim services provider.\n(b) \"Confidential communication\" includes a record that is created or maintained as a result of the communication described in Subsection (2)(a).\n(3) \"Institution\" means a Utah institution that is a private postsecondary educational institution or a public institution, including an institution of higher education listed in Section 53H-1-102.\n(4) \"Institutional advocacy service\" means a safety planning, counseling, psychological, support, advocacy, medical, or legal service that:\n(a) addresses issues involving:\n(i) sexual harassment;\n(ii) sexual assault;\n(iii) rape;\n(iv) domestic violence;\n(v) dating violence; or\n(vi) stalking; and\n(b) is provided by a qualified institutional victim services provider.\n(5)\n(a) \"Qualified institutional victim services provider\" means an organization that:\n(i) is affiliated with an institution;\n(ii) employs or provides volunteer opportunities for certified advocates;\n(iii) provides an institutional advocacy service to victims or families of victims; and\n(iv) is designated by the affiliated institution as a qualified institutional victim services provider.\n(b) \"Qualified institutional victim services provider\" may include an institution's:\n(i) sexual assault center;\n(ii) victim advocacy center;\n(iii) women's center;\n(iv) health center; or\n(v) counseling service center.\n(6) \"Record\" means a book, letter, document, paper, map, plan, photograph, film, card, tape, recording, electronic data, or other documentary material regardless of physical form or characteristics.\n(7) \"Victim\" means an individual who seeks an institutional advocacy service.","path":["Title 53H Higher Education","Chapter 53H-14 Data, Records, and Privacy","Part 53H-14-4 Confidential Communications for Institutional Advocacy Services"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter14/53H-14-S401.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"80989dd8a7fca4a61b334cb6d9471e92ec01a3cbc5867ba63cc94a9cf9db0031","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-14-305","next":"us-ut/utah-code-53h-14-402"},"notice":"GroundRules: Original legal text.
