{"data":{"id":"us-ut/utah-code-53h-14-502","jurisdiction":"us-ut","citation":"Utah Code § 53H-14-502","heading":"State student data protection governance.","body":"(1) The chief privacy officer shall establish a higher education privacy advisory group to advise institutions and institution boards of trustees on student data protection.\n(2) The advisory group shall consist of:\n(a) the chief privacy officer;\n(b) the higher education privacy officer; and\n(c) the following members, appointed by the commissioner:\n(i) at least one Utah System of Higher Education employee; and\n(ii) at least one representative of the Utah Board of Higher Education.\n(3) The advisory group shall:\n(a) discuss and make recommendations to the board and institutions regarding:\n(i) existing and proposed:\n(A) board rules; or\n(B) board policies of the Utah Board of Higher Education or institutions; and\n(ii) training on protecting student data privacy; and\n(b) perform other tasks related to student data protection as designated by the Utah Board of Higher Education.\n(4) The higher education privacy officer shall:\n(a) provide training and support to institution boards and employees; and\n(b) produce:\n(i) resource materials;\n(ii) model data governance plans;\n(iii) model forms for institution student data protection governance; and\n(iv) a model data collection notice.\n(5) The board shall:\n(a)\n(i) create and maintain a data governance plan; and\n(ii) annually publish the data governance plan on the Utah System of Higher Education website; and\n(b) establish standards for:\n(i) institution policies to protect student data;\n(ii) institution data governance plans; and\n(iii) a third-party contractor's use of student data.","path":["Title 53H Higher Education","Chapter 53H-14 Data, Records, and Privacy","Part 53H-14-5 Higher Education Student Data Protection"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter14/53H-14-S502.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"0b00cf72b9be977571f69958fd2e8e8786e22c7319d9eabffcd09046b4b8ff83","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-14-501","next":"us-ut/utah-code-53h-14-503"},"notice":"GroundRules: Original legal text.
