{"data":{"id":"us-ut/utah-code-53h-7-204","jurisdiction":"us-ut","citation":"Utah Code § 53H-7-204","heading":"Cause of action.","body":"(1) The following persons may bring an action in a state court of competent jurisdiction to enjoin a violation of this part or to recover compensatory damages, reasonable court costs, or reasonable attorney fees:\n(a) the attorney general; or\n(b) a person claiming that the person's rights, as described in this part, were violated.\n(2) In an action brought under this part, if the court finds a violation of this part, the court:\n(a) shall enjoin the violation;\n(b) shall, if a person whose rights, as described in this part, were violated brought the action, award the person:\n(i) at least $500 for an initial violation; and\n(ii) if the person notifies the institution of the violation, $50 for each day the violation continues after the notification; and\n(c) may award a prevailing plaintiff:\n(i) compensatory damages;\n(ii) reasonable court costs; or\n(iii) reasonable attorney fees.\n(3) Notwithstanding Title 63G, Chapter 7, Governmental Immunity Act of Utah, an institution that violates this part is not immune from suit or liability for the violation.","path":["Title 53H Higher Education","Chapter 53H-7 Students' Rights and Responsibilities","Part 53H-7-2 Campus Free Expression"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter7/53H-7-S204.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"6dccab39e2e8508bdd6741b06985bd6d4826ed9d9dba877a31bb86eb177b54b4","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-7-203","next":"us-ut/utah-code-53h-7-205"},"notice":"GroundRules: Original legal text.
