{"data":{"id":"us-ut/utah-code-53h-8-501","jurisdiction":"us-ut","citation":"Utah Code § 53H-8-501","heading":"General provisions -- Definitions.","body":"As used in this part:\n(1) \"Conditional gift\" means a gift as defined in Subsection (4) that is subject to conditions:\n(a) imposed, requested, or provided by a foreign government or foreign person; and\n(b) that relate to:\n(i) what kinds of teachers or students may benefit from the gift; or\n(ii) a description of the subject matter to be taught with the support of the gift.\n(2) \"Foreign government\" means a government other than the government of:\n(a) the United States;\n(b) a state within the United States;\n(c) a territory or possession of the United States; or\n(d) a political subdivision of the United States.\n(3) \"Foreign person\" means:\n(a) a foreign government defined in Subsection (2);\n(b) an individual who is not a citizen or national of the United States or of a territory or protectorate of the United States;\n(c) a corporation, partnership, joint venture, proprietorship, trust, association, or other entity that is created or organized under the laws of a foreign government or that has its principal place of business located outside the United States;\n(d) if known by the institution, a corporation, partnership, joint venture, proprietorship, trust, association, or other entity that is created or organized pursuant to the laws of the United States or a state within the United States, if a majority of the stock or other equity interest is directly or indirectly owned by, or which derives a majority of its funding from:\n(i) a foreign government;\n(ii) an individual described in Subsection (3)(b); or\n(iii) an entity described in Subsection (3)(c) or (d); or\n(e) if known by the institution, a committee or other group in which a majority of the membership is composed of:\n(i) a foreign government;\n(ii) an individual described in Subsection (3)(b); or\n(iii) an entity described in Subsection (3)(c) or (d).\n(4) \"Gift\" means an endowment, scholarship, gift, donation, or grant of money or property of any kind.\n(5) \"Restricted foreign entity\" means:\n(a) a company that the United States Secretary of Defense is required to list as a military company under the requirements of federal national defense authorization acts;\n(b) any affiliate of a company described in Subsection (6)(a);\n(c) the country with a commercial or defense industrial base of which a company described in Subsection (6)(a) is a part; or\n(d) any subsidiary of a company described in Subsection (6)(a) or a country described in Subsection (6)(c).","path":["Title 53H Higher Education","Chapter 53H-8 Finance","Part 53H-8-5 Foreign Bank Accounts and Foreign Gifts"],"source_url":"https://le.utah.gov/xcode/Title53H/Chapter8/53H-8-S501.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"35e17c920d5ddeae7c15d95302503478199668514d95134370e3e22ae2fb21e9","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-53h-8-404","next":"us-ut/utah-code-53h-8-502"},"notice":"GroundRules: Original legal text.
