{"data":{"id":"us-ut/utah-code-54-17-103","jurisdiction":"us-ut","citation":"Utah Code § 54-17-103","heading":"Rulemaking.","body":"(1) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the commission:\n(a) shall make rules when required by this chapter; and\n(b) in addition to the rules required under Subsection (1)(a), may make rules necessary for the implementation of this chapter.\n(2) Notwithstanding a requirement that the commission make rules, the commission may take action under this chapter before the commission makes a required rule including:\n(a) approving a solicitation process under Part 2, Solicitation Process;\n(b) approving a significant energy resource under Section 54-17-302;\n(c) issuing an order under Section 54-17-304 regarding whether an affected electrical utility should proceed with implementing a significant energy resource decision;\n(d) approving an energy resource under Section 54-17-402; or\n(e) issuing an order under Section 54-17-404 regarding whether an energy utility should proceed with implementing a resource decision.","path":["Title 54 Public Utilities","Chapter 54-17 Energy Resource Procurement Act","Part 54-17-1 General Provisions"],"source_url":"https://le.utah.gov/xcode/Title54/Chapter17/54-17-S103.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"8baafccfb1eaa531797df2ba8d96977d504b1f185f9dcc18968dff6a960864d7","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-54-17-102","next":"us-ut/utah-code-54-17-201"},"notice":"GroundRules: Original legal text.
