{"data":{"id":"us-ut/utah-code-57-1-23.5","jurisdiction":"us-ut","citation":"Utah Code § 57-1-23.5","heading":"Civil liability for unauthorized person who exercises power of sale.","body":"(1) As used in this section:\n(a) \"Unauthorized person\" means a person who does not qualify as a trustee under Subsection 57-1-21(1)(a)(i) or (iv).\n(b) \"Unauthorized sale\" means the exercise of a power of sale by an unauthorized person.\n(2)\n(a) An unauthorized person who conducts an unauthorized sale is liable to the trustor for the actual damages suffered by the trustor as a result of the unauthorized sale or $2,000, whichever is greater.\n(b) In an action under Subsection (2)(a), the court shall award a prevailing plaintiff the plaintiff's costs and attorney fees.","path":["Title 57 Real Estate","Chapter 57-1 Conveyances"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter1/57-1-S23.5.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"eff815206f4d1b647df1bf460c29674657c643fc1c204978034991ca34c3bf59","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-1-23","next":"us-ut/utah-code-57-1-24"},"notice":"GroundRules: Original legal text.
