{"data":{"id":"us-ut/utah-code-57-13b-201","jurisdiction":"us-ut","citation":"Utah Code § 57-13b-201","heading":"Prescriptive easement for livestock trail.","body":"(1) A prescriptive easement may be established if:\n(a) a property owner uses an historical livestock trail that crosses another person's property for a period of 20 years; and\n(b) the use of the other owner's property as an historical livestock trail for the 20-year period described in Subsection (1)(a) is:\n(i) continuous;\n(ii) open and notorious; and\n(iii) adverse.\n(2) If a property owner establishes that a use is continuous and open and notorious under Subsections (1)(b)(i) and (ii), there is a rebuttable presumption that the use is adverse.\n(3) Notwithstanding Subsections (1) and (2), a prescriptive easement under this chapter may only be established on private lands.","path":["Title 57 Real Estate","Chapter 57-13b Easement for Historical Livestock Trail Act","Part 57-13b-2 Prescriptive Easement"],"source_url":"https://le.utah.gov/xcode/Title57/Chapter13b/57-13b-S201.html","current_through":"2026 General Session","vintage":"","retrieved_at":"2026-09-03T11:34:33Z","sha256":"ab50127e79059a89930e2a947e82d888ff4374f60a3f1b81b07be1450667a4d0","source_id":"us-ut","stale":false,"prev":"us-ut/utah-code-57-13b-102","next":"us-ut/utah-code-57-13c-101"},"notice":"GroundRules: Original legal text.
